Terms of Use

These Terms of Use ("Terms") govern your use of the Deeply Focus application ("App"), available on iPhone, developed by Gourav Bagora ("we", "our", or "us"). By downloading or using the App, you agree to be bound by these Terms.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial productivity purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Use the App in any way that violates applicable laws or regulations.
• Use the App for any commercial purpose without our prior written consent.

Deeply Focus offers an optional paid subscription ("Deeply Focus Pro") that unlocks additional features. By subscribing, you agree to the following:

• Billing: subscriptions are billed through your Apple ID account via the App Store. Payment is charged at confirmation of purchase.
• Auto-renewal: subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Managing your subscription: you can manage or cancel your subscription in your Apple ID Account Settings at any time. Cancellation takes effect at the end of the current billing period; you retain access to Pro features until then.
• Free trial: if a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Price changes: we may change subscription prices at any time. Price changes will take effect at the start of your next billing period after adequate notice.
• Refunds: all purchases are final and non-refundable except as required by applicable law or as set out in Apple's refund policy.
• iCloud Sync: iCloud Sync is a Pro-only feature that requires an active subscription and a valid iCloud account. If your subscription expires, iCloud Sync is automatically disabled. Your local data is never deleted as a result of subscription expiry.

From time to time we may offer promotional or discount codes for Deeply Focus Pro. By redeeming a code, you agree that:

• Redemption: codes are redeemed through the Apple App Store and apply to your Apple ID account.
• Limits: codes are subject to availability, may expire, are non-transferable, hold no cash value, and are limited to one redemption per eligible account unless stated otherwise.
• No combining: codes cannot be combined with other offers or promotions.
• After the promotional period: unless cancelled, your subscription renews at the standard price in accordance with the App Store's terms.
• Changes: we may modify, suspend, or discontinue any promotional offer at any time.

All content you create within the App, including session records, tags, task names, and planner items, is stored locally on your device. You retain full ownership of your data.

We do not claim any rights over content you create within the App. You are solely responsible for backing up your data. Deleting the App will permanently erase all locally stored data.

iCloud Sync (Pro only): If you enable the optional iCloud Sync feature, your data is additionally stored in your personal iCloud account via Apple CloudKit. This data is governed by Apple's iCloud Terms of Service and Privacy Policy. We have no access to your iCloud data. Disabling iCloud Sync or cancelling your Pro subscription stops future syncing; data already in iCloud remains in your Apple account until you remove it manually.

Leaderboard & Focus Rooms (optional): if you sign in with Apple to use the Leaderboard or Focus Rooms, certain information (your nickname, avatar, aggregate focus minutes, and live room presence) is stored on Firebase servers and may be visible to other users as described in our Privacy Policy. This is separate from iCloud Sync and from your locally stored session data.

Deeply Focus offers optional social features — a global Leaderboard and live Focus Rooms — that let you see how your focus time compares to other users and focus alongside them. Participating requires signing in with your Apple ID via Sign in with Apple.

• Public visibility: if you opt in, your nickname, avatar, and aggregate focus-minute totals may be visible to other users, including on the public Leaderboard (viewable without an account) and to other members of any Focus Room you join.
• Nicknames are auto-generated: your Leaderboard/Focus Rooms nickname is assigned automatically by the App from a fixed word list and cannot be freely typed or edited, so it cannot itself carry offensive or impersonating content. Your avatar is chosen from a fixed set of illustrations we provide — there is no photo or custom image upload. Room names and topics, however, are set by whoever creates a room, and remain subject to the conduct rules below.
• Respectful use of Focus Rooms: room names, topics, reactions, and room presence are intended to support focus, not to harass, spam, impersonate, or disrupt other users. We may remove or rename a room, remove you from a room, revoke access to social features, or terminate your account for abuse.
• Reporting & blocking: the App lets you report a user or a room, and lets you block a user so they no longer appear in your own view of the Leaderboard or Focus Rooms. Reports are reviewed by us and used solely for moderation; submitting a report does not guarantee any particular outcome, and misusing the reporting feature (e.g. false or malicious reports) is itself a violation of these Terms. Blocking is a personal, local setting — it does not notify or otherwise affect the blocked user.
• No guaranteed availability: the Leaderboard and Focus Rooms depend on third-party infrastructure (Firebase) and are provided on a best-effort basis; we do not guarantee uninterrupted availability, real-time accuracy, or permanent retention of rankings or room history.
• Account & data: your Leaderboard/Focus Rooms account is tied to Sign in with Apple and is independent of any iCloud Sync you may have enabled. Deleting the app does not automatically delete your Leaderboard entry — use the in-app option to remove it, or contact us.

You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You must not use the App to:

• Violate any applicable local, national, or international law or regulation.
• Transmit any unauthorized or unsolicited advertising or promotional material.
• Attempt to gain unauthorized access to any part of the App or its related systems.
• Interfere with or disrupt the integrity or performance of the App.
• Use an offensive, impersonating, or misleading avatar, room name, or room topic on the Leaderboard or in Focus Rooms.
• Harass, spam, or disrupt other users through reactions, Focus Room presence, or any other social feature.
• Submit false, malicious, or abusive reports against other users or rooms, or attempt to circumvent another user's block of you.

The App and its original content, features, and functionality are and will remain the exclusive property of Gourav Bagora. The App is protected by copyright, trademark, and other applicable laws.

The Deeply Focus name, logo, and all related design elements are trademarks of Gourav Bagora. You may not use these trademarks without our prior written permission.

The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.

Deeply Focus is a productivity tool designed to help you manage your time and focus. We make no claims regarding the effectiveness of the Pomodoro Technique or any productivity outcomes from using the App.

To the maximum extent permitted by applicable law, Gourav Bagora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of profits, arising out of your use of or inability to use the App.

Our total liability to you for all claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App or any in-app purchases in the 12 months preceding the claim.

These Terms are between you and Gourav Bagora only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.

Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App will immediately cease.

All provisions of these Terms which by their nature should survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability, shall survive termination.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, through an in-app notice. Your continued use of the App after changes take effect constitutes your acceptance of the new Terms.
